Plaintiff in error David Le Barron (hereinafter the "defendant") was charged with attempted rape contrary to secs. 939.32 and 944.01, Stats. After preliminary hearing he entered pleas of not guilty and not guilty by reason of insanity and feeblemindedness. Trial was had to a jury which returned a verdict of guilty. On June 21, 1965, judgment was entered adjudging defendant guilty of the offense charged and sentencing him to an indeterminate term of not more than fifteen years in state prison. Thereafter, defendant moved for a new trial on the grounds, among others: (1) The verdict was contrary to the law and the evidence; (2) defendant was inadequately represented by trial counsel; and (3) in the interests of Justice. This motion for new trial was denied by order entered April 12, 1966.
